Pursuant to the provisions of the law on consumer protection no. 4077 amended by the law numbered 4822 and the regulation on the application procedures and principles of distance agreements, a contract must be drawn up for sales made over the internet.

With the acceptance of this contract, SEZDEN TURİZM SEYAHAT REKLAM TİCARET VE SAN. LTD. STI. You are deemed to have accepted the tour conditions.

I. PAYMENTS

At the time of registration, at least 10% of the remaining balance of the reservation price must be paid before the start of the tour/reservation at the latest. If the specified payments are not made within the aforementioned periods, the reservation will be cancelled. In this case, 10% of the trip cost is billed to the consumer as compensation for withdrawal.

II. REGISTRATION-CANCELLATION-TRANSFER-CHANGES

The agency may cancel the trip due to such force majeure as the required number of passengers and/or adverse weather conditions, road obstructions, strikes, terrorism, war, the possibility of war, unpredictable technical issues that prevent the start or continuation of the trip, in this case, the consumer’s compensation has no right.

A- In case the consumer requests cancellation-change up to 15 days before the start of the trip, the full fee is refunded. No deposit or full refund will be made if not notified within 15 days.

B- If the consumer requests a cancellation-change 15-8 days before the start of the trip for a reason other than the fact that he or his first-degree relatives have documented their 10-day illness and death with an official report from a full-fledged state hospital, 35% of the trip cost It accepts and undertakes to pay the full amount of the trip to Pegatour.com, if less than 7 days are left. Cancellation request should be notified in writing to [email protected] e-mail address or to our whatsapp contact number. Verbal notifications are invalid.

C- If the consumer wants to cancel the Early Booking Discounted Product purchased during the discounted sale period for any reason, 10% of the trip cost is less than 7 days before the trip start date, if the entire trip cost is SEZDEN TURİZM SEYAHAT ADVERTISING TİCARET VE. In cases where a prepayment is made to one of the D-Tours, your registration becomes final. In tours with more than 2 nights, until 7 days before the departure of the tour, until 3 days before the departure of the tour in tours with less than 2 nights, until 24 hours before the departure of the tour in daily tours; If the rest of the tour fee is not paid, the person may lose all their rights related to the tour registration. The place reserved for him in the tour can be put up for sale again. The participant who has a prepayment for the tour continues to be responsible for all the payment. The invoice is issued and the remaining fee is collected after the prepayment. These periods can be extended or shortened by agreement of the parties.

Until the full payment of the E-Tour participation fee or the completion of the installment sales process with a credit card, the participant will not be deemed to have made a final reservation.

F-A change to the date of the same round may only occur if:

G-Switching to a different tour on the same date can only occur under the following conditions:

H-Since all our tours are not strictly active and our quotas are limited, the tour reservations you make on our website are confirmed in a controlled manner. If you make a reservation for any of our tours on the site, your reservation will be confirmed by our reservation confirmation system. Therefore, your reservation will not be completed without our reservation confirmation. In other words, the reservation you have made on our site will not be a definite reservation until you receive the reservation confirmation.

I- Pegatour reserves the right to correct the amount in case of missing or over-drawing from the relevant tour price as a result of errors that may occur in the payments made on the site. In such cases, the stated sales price of the tour is taken into account, not the amount withdrawn.

For J-Charter flights, cancellations of 15 days or more are not valid and airfare is not refunded.

Name changes can be made up to 7 days before K-Charter flights. However, name changes cannot be made on scheduled flights. In case the consumer loses his ticket, he is obliged to pay the penalty imposed by the relevant airline.

The consumer can transfer it to any person he wants until 7 days before the start of the tour. The transferor is responsible for the balance and the costs arising from the transfer together with the transferor.

Pegatour.com has the right to cancel all reservations made on behalf of the consumer 24 hours after the start date of the tour, unless the consumer notifies in writing that he/she will participate in the tour that he/she missed. No refund will be made to the consumer for such cancellations.

Pegatour may partially or completely cancel tours with accommodation up to 10 days and daily tours up to 3 days before the start of the trip, which it has announced or registered, provided that it notifies the consumer, when it deems necessary. Within the same period, the name of the hotel within the scope of the trip, transportation vehicles and their places of departure, the order of visits of the places specified in the program and shown as places to visit can be changed. If the consumer does not accept these changes and cancellations, he has the right to cancel the reservation and get a full refund of the price paid. In this case, the consumer does not have the right to receive compensation.

III.GENERAL PROVISIONS

Pegatour reserves the right to change the names of the hotels within the scope of the trip, the means of transportation, the departure times and their places of departure, by notifying the consumer, or to transfer the consumer to another agency, provided that the standards specified in the program are adhered to. Tour programs given during registration are draft, general programs. The days on which the excursions specified in the tour programs will be organized can be changed at the initiative of the guides. The consumer accepts that the travel conditions have been fulfilled if the overnight stay in the total trip period is not shortened and the class and categories of the facilities to be stayed are not changed.

The consumer who participates in the tour has the right to bring and take 2 suitcases, provided that they are not larger than 50 cm x 70 cm in all kinds of trips, and 20 kg of luggage for travels by plane and for more than 3 nights. All responsibilities of the suitcases and their contents belong to their owners.

Items that smell, flow, have flammable or explosive properties or cause discomfort to the environment, cutting, piercing, firearms and all kinds of animals are not allowed into vehicles and accommodation facilities without the express and written permission of the agency.

In case of luggage loss or damage caused by the gross negligence of the agency personnel, 1/2 of the amount of transportation within the total cost of the trip is paid as material and moral compensation for the lost goods and luggage, regardless of the material and moral value of the lost or damaged luggage, as well as other qualities and characteristics. It is paid by the agency to the consumer who owns the goods. The agency is responsible for all kinds of loss, damage and theft of the goods delivered by the consumer together with their values in writing, up to the transportation cost of the participant.

The event cancellation notification of the registered tour by the agency can be made to each consumer individually, or to the group leader in group reservations, by means of an announcement in one of the written and verbal media channels.

The agency is responsible for the reasons other than force majeure that will occur after the start of the tour in the tour program purchased by the consumer. In cases where necessary, the agency may compensate the changes against the consumer in accordance with the provisions of the TÜRSAB Kütahya schedule, in the form of a price or service refund, as well as with additional and/or alternative arrangements, which are not included in the price and given to the consumer during the trip. The fact that additional or substitute services have been purchased, used or consumed by the consumer eliminates the consumer’s right to refund and compensation.

If the consumer leaves the tour with the bet that the service is defective, he has to notify the agency official and the hotel where he is staying in writing, together with the reasons, that he has left the tour. Otherwise, the consumer is not deemed to have left the tour and is deemed to have received and used the service.

It is the bona fide consumer’s duty of care to notify the consumer of the issues he or she complains about in writing during the performance of the service. The consumer’s use of the service to the end, despite the complaint, eliminates the right to compensation such as replacement service and refund for the issues he complains about.

The consumer(s) who do not sign the contract but participate in the tour subject to the contract are deemed to have accepted and committed to the terms of the contract when the consumer(s) they have assigned to register on their behalf sign this contract. Despite this, the agency has the right of recourse for the excess amount paid by the consumers who signed the contract against the agency and in case of lawsuits and proceedings related to the trip they participated in, and in the event that the agency has to pay the consumer a price or compensation other than the ones written in this agreement, on the grounds that they do not personally sign the contract. reserved. Even if the consumers who participated in this tour did not sign the contract, they learned the terms of this contract, which will be valid between the parties, due to the brochure, catalog, website, participation form and advertisements, and agreed to participate in the tour under the terms of this contract.

The agency acts as an intermediary before the consumers who will participate in the trip, the hotel, the carrier companies and all kinds of third parties and legal entities that provide other services related to the trip. For this reason, contrary to the agreements made between the agency and the institutions undertaking the transportation of the consumers who registered for the trip with their application; Any failures arising from the vehicle’s own fault or personal faults of third parties or unforeseen technical issues due to the vehicle being absent from the departure point at the times shown in the schedules, all kinds of delays of land, air and sea vehicles, strikes, terrorism, the possibility of war or similar force majeure reasons, material and moral problems. Parties are aware of the fact that the agency has no current responsibility for damaged accidents, deficient or faulty services of accommodation facilities, due to the fact that the agency is not the operator, and that it is not directly responsible like the main perpetrator. For this reason, the agency is not indebted to the consumer, jointly and severally, like the main perpetrator. In cases of such malfunctions and accidents, the consumer will primarily seek material and moral demands from the main perpetrators and collect them. In cases where it cannot fully receive its receivables, the amount that can be claimed from the agency within the strict liability rules may be the amount that cannot be collected from the main perpetrators.

Pegatour conveys the demands of the consumers regarding room selection in accommodation facilities to the relevant facility; however, it cannot guarantee that the request will be fulfilled. Rooms cannot be delivered to consumers before 14:00 on the day of arrival at the hotel. On the day of departure from the hotel, consumers are required to vacate their rooms by 11:00 at the latest.

Our sales are made in cash or in cash with banks’ credit cards and/or in installments with banks’ credit cards. If the payment is not made in sales by credit card, the consumer is in contact with the bank with which the credit card contract is signed, and the interest rates to be applied by the bank are valid. For this reason, pegatour is not an interlocutor.

All our activities are group activities. The success and peace of the group are at the forefront. Individual behavior is not allowed. The group leader is the sole authority throughout the tour. If the group leader thinks that your health or general behavior is causing problems with the health, unity, general structure, security and peace of the group, he may ask you to leave the tour. In such cases, the leader prepares the report and has the other group members sign the report. The person who is asked to leave the group does not have any right to compensation.

Photographs taken during any trip, tour and organization organized by our agency can be used for all kinds of marketing methods such as promotions and advertisements related to visual materials.

Pegatour must keep the information of the reservation owner confidential. The parties accept the Pegatour records as definitive evidence in case of any dispute. Antalya courts and enforcement offices are authorized for disputes that may arise from this contract.

IV. FORCE MAJEURE CASES

Force majeure as stated in the law, situations that occur due to extraordinary and unpredictable events despite having taken all the necessary care and precautions and that prevent the start, continuation or termination of the package tour, situations where the agency has no influence on the event that has arisen. considered cause.

These cases are;

a) Natural disasters such as earthquakes, fires, volcanic eruptions, floods, storms, hurricanes, fog, avalanches, lightning, and similar situations and events, including but not limited to natural disasters or epidemics, nuclear, chemical disasters or fallouts, epidemics, etc. emergency situations.

b) In cases of emergency preventing international air, land and sea transportation, in cases of war or mobilization, public uprisings, attacks or terrorist movements, sabotage, in the border neighbors of Turkey or in the countries/cities to be visited within the scope of package tours, at the border gates and/or in the country adjacent to the border gate, including but not limited to riots, occupation and civil war, revolution, insurrection, forced seizure, military coup or seizure of power, civil unrest, industrial disputes, government sanctions, embargo, strikes, lockouts, port closures or occupancy situations or situations that may prevent employees from work.

c) Other force majeure situations determined by the parties according to the type of package tour

In cases where there is force majeure, Pegatour cannot be held responsible for the damages arising from the failure to perform the contract at all or properly. Pegatour’s representatives in that location are obliged to provide prompt assistance in case the consumer is in a difficult situation.

V. OTHER PROVISIONS:

Child discounts apply if children stay in the same room with their parents as the 3rd or 4th person.

In case of cancellation of the tour by the consumer, it has been accepted by the reservation owner that it is not possible to return this price to the consumer, since the flight ticket price has been paid in advance to the airline company. In this case, the consumer has no right to compensation.

In case the return conditions are fulfilled, the original invoice must be returned to the agency in order to be able to refund after the invoice is issued.

In installment sales, if the debtor defaults in paying two installments, the remaining debt becomes due.

The reservation owner accepts and undertakes to pay his debts within the terms specified in this contract. In the event that the debtor defaults in paying his debt, a penalty of 5% of the total reservation and a monthly delay interest of 17% will be applied without any warning. (For payments made by card, the rights of the institution in the contract signed by the cardholder with the institution remain.)

If it is understood that the characteristics (such as age) declared during the reservation of the children who will stay for free or at a discount in accordance with the criteria determined by the facility, are not correct, these children will be paid immediately and fully and all kinds of compensation will be made.

Travel insurance assurance package fees belong to the reservation owners. The scope of coverage for incomplete or defective performance, damage, loss and loss of consumers who purchase travel insurance service or is included in the travel insurance package is determined by the policy of the insurance company that provides this service. The agency does not bear any responsibility for the content, scope or application of these guarantees.

If there is a conflict between the copy of the contract left by the consumer and the copy left by the agency, the copy records remaining in the agency will be taken as basis.

In Airplane Tours, the Airline Company may change the Flight Direction and Flight Time, depending on the density of the aircraft. Pegatour reserves this right by notifying the guests of the change at least 36 hours in advance and arranging the service. Each of our guests participating in the tour is deemed to have accepted the change in advance.

The parties accept and declare that the addresses and telephone numbers specified in this contract are correct and are valid unless the changes are notified in writing.
